General terms and conditions of sale

1. General

These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) apply to orders placed by any person (hereinafter referred to as the “Customer”) on the website www.swisschocolates.be (hereinafter referred to as the “Site”) of Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique in Belgium, whose registered office is located at boulevard Emile Jacqmain 16, bt 74, 1000 Brussels, VAT No. 0721 876 869.

The General Terms and Conditions apply exclusively to all online orders placed on the Site. No other special conditions issued by the Customer may prevail (unless expressly waived in writing).

The GCS may be subject to change. The GCS applicable to orders placed on the Site are those in force at the time the order is finalised by the Customer.

Placing an order for products offered for sale on the Site is subject to acceptance of the GTCS.

Questions relating to the characteristics and quality of the products sold on the Site, as well as the nutritional information concerning them, may be addressed to the attention of the Consumer Service:

Questions or complaints relating to the terms and conditions of orders and to orders placed by the Customer on the Site may be addressed using the contact form.

 2. Connecting to the Site

To place an order, the Customer may either create an account on the Site before placing an order, or place an order without creating an account, using the Site as a Visitor.

When the Customer creates an account, they provide their surname, first name, postal address, telephone number and email address and choose a password. These details are then recorded by Ju & A Group SPRL, the Lindt Distributor in Belgium. His email address will be his identifier. The Customer can then access his account using his login and password, place orders and consult the history of orders placed. The identifiers that the Customer will have defined when logging in will enable them to recall and modify their data at any time.

When the Customer uses the Site as a Visitor, he/she provides his/her surname, first name, postal address, telephone number and email address when placing each order.

In both cases, the Customer must provide accurate and complete information necessary to process the order. The protection and confidentiality of Customer data is ensured by Ju & A Group SPRL, Distributeur Lindt en Belgique, in accordance with § 10 of these GTC and its Privacy Policy.

 3. Products and availability

On the Site, the Company Ju & A Group SPRL, Distributeur Lindt en Belgiqueoffers for sale the following three (3) categories of products:

– chocolates packaged in boxes, sachets, boxes or other ;

– objects such as bags, aprons, cuddly toys or others (the “Accessories”);

– compositions including both chocolates and Accessories (the “Compositions”).

The products offered for sale on the site are presented with their essential characteristics (price including VAT, net weight, ingredients, photo) so that the customer has as much information as possible before placing an order. This information is not contractual. Several of our products contain allergens such as nuts, lai, soya, eggs, sesame, gluten, wheat and peanuts. Further information can be obtained from our shops in Brussels.

The photographs illustrating the products are not contractual. The Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique, cannot be held responsible for minor variations in the presentation of the products and do not affect the validity of the sale.

The product offers presented on the Site are valid as long as they are online, within the limit of available stocks.

In the event of unavailability of products from Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique will inform the Customer by email or telephone, within two (2) working days following the order. The Ju & A Group SPRL, Distributeur Lindt en Belgique may offer the Customer a product of equivalent quality and price to the unavailable product. If this solution does not suit the Customer, the order will be cancelled and the Customer’s bank account will not be debited.

4. Order

The Customer undertakes to complete the order form accurately and to fill in the various sections required to place the order (billing address, delivery address, method of payment, etc.). The Customer undertakes to ensure that the personal information provided is true. The Customer may modify the contents of their basket and the information entered on the order form at any time, in particular in order to correct any input errors, as long as they have not validated their order by clicking on “Place Order”. As soon as the Customer clicks on the “Place Order” button, they undertake to purchase the products placed in their basket.

As soon as the Customer has finalised their online order, an e-mail summarising the essential information about the order will be sent to them. The Customer’s bank account will only be debited once the order has been validated by La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique (the Customer may receive an invoice on simple request by email to valerie.goossens@vernetgroup.eu).

5. Right of withdrawal

According to Book VI of the Code of Economic Law, there is no right of withdrawal for food products, perishable goods and chocolate products made to the specifications of the Purchaser. All purchases are therefore final and will not be taken back by Ju & A Group SPRL, the Lindt Distributor in Belgium.

 6. Prices and terms of payment

On the Site, prices are indicated in euros, inclusive of all taxes and exclusive of delivery costs (see article 7).

The Ju & A Group SPRL, Distributeur Lindt en Belgique may update or modify the prices applicable to the products at any time. However, the prices are guaranteed as soon as the Customer places the products in his basket. The Customer may only pay online by credit card.

The data is entered by the Customer on the INGENICO ePayments secure banking platform using SSL encryption technology, guaranteeing the security and confidentiality of the information entered and during the transaction.

The order will only become effective once the transaction has been authorised by the bank payment centres and the payment has been validated by Ju & A Group SPRL, Lindt Distributor in Belgium. To be registered, the order must be paid in full. Unpaid orders cannot be delivered. Please note that your credit card will be debited immediately at the time of the transaction.

The invoice corresponding to the order placed by the Customer is sent by email and is also available online on the Customer’s account. It may also be sent by separate post at the Customer’s request.

7. Delivery

7.1 General information

The company Ju & A Group SRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique, after confirmation of the order, undertakes to process and transport the order to the delivery address indicated by the Customer, according to the mode of transport chosen by the Customer. The Société Ju & A Group SPRL, Distributeur Lindt en Belgique will take care of the goods up to the point of delivery. It is the responsibility of the recipient to check the parcel in the presence of the delivery person. Any anomaly upon delivery must be noted in writing on the delivery slip in the presence of the carrier. The Customer has a period of three (3) days (excluding public holidays) from receipt of the products to send the carrier a registered letter describing the damage noted. In the event of a complaint against the carrier, the Customer must notify La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgiquwithin three (3) days of receipt of the products.

7.2 Packaging

All parcels are packaged by Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique, directly in the Lindt boutiques in Brussels and in closed packaging adapted to the requirements of transport.

7.3 Delivery address

Products are delivered to the delivery address indicated by the Customer during the ordering process. This may be the Customer’s address or the address of a third party, for example for the delivery of a gift order. In this case, the Customer provides his or her own details for the billing address. The Customer undertakes to ensure that the information provided at the time of ordering is true. In the event of an error in the details of the recipient, Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held responsible for the impossibility of delivery to the recipient. The re-routing of the parcel to another recipient or to a new delivery address will be invoiced to the Customer.

7.4 Possible places of delivery

Deliveries are made exclusively in Belgium and Continental Europe.

7.5 Delivery times

Orders are processed and delivered as quickly as possible by Ju & A Group SPRL, Distributeur Lindt en Belgique. Ju & A Group SPRL, Distributeur Lindt en Belgique endeavours to deliver orders within the time period communicated in the individual order confirmation. Any delay will under no circumstances give rise to compensation. Incorrect delivery addresses are the responsibility of the User and may result in additional costs which will be passed on to the User.

In order to guarantee Customers optimum product quality, during the summer and in periods of high temperatures (>22°C), the dispatch of orders may be delayed and is carried out when temperatures have fallen. This ensures optimum quality of Lindt products and prevents them from being altered by heat during transport. The customer will be explicitly informed of this postponement before confirming the order. In the event of high temperatures, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgiques reserves the right to postpone or cancel a shipment, with the agreement of the Customer, in particular in the event of a heat wave.

In such cases, the Customer will be informed during the ordering process or by email.

The standard delivery time is 2 to 5 working days for Belgium (Monday to Friday) from the time the order is placed, excluding periods of high temperatures, and 1 week for Europe.

Notwithstanding the above

– for orders over 25 kg which require a longer preparation time, and

The Ju & A Group SPRL, Distributeur Lindt en Belgique endeavours to deliver products as quickly as possible. In this case, the maximum delivery time is thirty (30) days from the placing of the order.

Due to the end of year festivities, Easter and exceptional circumstances resulting in a restriction of postal service activities, delivery times for orders may exceptionally be extended, but may not exceed thirty (30) days from the placing of the order.

7.6 Delivery charges

Delivery costs are €5 for Belgium for orders of up to 20 kilos. They may depend on the weight and number of packages.

For all orders over 45.00€, delivery in Belgium is free.

You will find below the delivery charges applicable to all orders placed on the site. These charges include all taxes.

For all orders over 95.00€, delivery within Europe (excluding Belgium) is free of charge.

The Company Ju & A Group SPRL, Distributeur Lindt en Belgique is not responsible for the failure of the delivery if the purchaser indicates an erroneous or obsolete address, if nobody is present at the address indicated by the purchaser.

7.7 Late delivery

Questions relating to late delivery may be addressed :

– using the contact form ;

– by email to valerie.goossens@vernetgroup.eu.

The Customer may also request the cancellation of his order in the event of late delivery, if after a written injunction sent by the Customer to Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique, the latter has been unable to make delivery within seven (7) days of the said injunction, unless the late delivery is due to force majeure. The Company Ju & A Group SPRL, The Company Ju & A Group SPRL, The Company Ju & A Group SPRL, Distributeur Lindt en Belgique will then proceed with the reimbursement of the price of the product ordered at the latest within thirty (30) days following its request.

In accordance with the stipulations of article 7.5 above, for deliveries relating to :

only deliveries made after the maximum period of thirty (30) days referred to in article 7.5 will be considered as late deliveries.

The Company Ju & A Group SPRL, The Company Ju & A Group SPRL, The Company Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held responsible for any delay due to force majeure or to an error or omission in the delivery address indicated by the Customer.

7.8 Absence of the recipient at the time of delivery

If the recipient or a person who can take possession of the products is absent at the time of delivery, the carrier will leave a delivery notice at the delivery address indicated by the Customer. This notice will indicate a representation the following day or will invite the Customer to collect the products within a period of fifteen (15) days from a specific collection point. Under no circumstances can Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique be held responsible for any delay in delivery or any deterioration of the products due to their late collection from the carrier.

 8. Guarantees

The expiry date (DLUO) of LINDT chocolates is indicated on each product containing chocolate. The average remaining shelf life of the products delivered is two (2) to five (5) months.

Ju & A Group SPRL, Distributeur Lindt en Belgique guarantees the quality and freshness of its products provided they are kept in a cool place (between 14 and 18°C), protected from light.

The Company Ju & A Group SPRL, Distributeur Lindt en Belgique invites the Customer to check the goods delivered on receipt and to compare them with his order.

All complaints must be made within a maximum of 3 days of receipt to Société Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgiquede Belgique, boulevard Emile Jacqmain 16, bt 74 à 1000 Bruxelles, N° TVA 0721 876 869.cette réclamation devra comporter le maximum de justificatifs pour démontrer le préjudice subi.

In the event of a defective product or a non-conforming order, the Customer is entitled to demand that the product be replaced by Ju & A Group SPRL, the Lindt Distributor in Belgium. If the replacement of the product ordered by an identical product is impossible, or cannot be implemented by La Société Ju & A Group SPRL, Distributeur Lindt en Belgique within one (1) month following the Customer’s complaint, the Customer may either return the defective product or the non-conforming order and obtain a refund (including delivery costs); or benefit from a price reduction after analysis and acceptance of the complaint by La Société Ju & A Group SPRL, Distributeur Lindt en Belgique .

In the event of a refund, the item must be returned to La Société Ju & A Group SPRL, Distributeur Lindt en Belgique within 14 days of receipt. The Customer must send it in its original packaging or in another packaging guaranteeing the safety of transport, enclosing a copy of the invoice, to the following address:

If the Customer opts for the reduction of the purchase price, he will keep the product and La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique will reimburse him the amount of the agreed reduction, by crediting the card used for the online payment of the order (secure transaction), within seven (7) days.

 9. Retention of title

The goods delivered remain the property of La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique until full payment of the purchase price. The transfer of risks to the Customer takes place upon delivery of the order.

10. Use of stored data / Data protection

Ju & A Group SPRL, Distributeur Lindt en Belgique is aware of the importance of discretion in the processing and protection of information. The Ju & A Group SPRL, Distributeur Lindt en Belgique wishes its customers to feel secure when they visit its Site. This is why the protection of data linked to the presence of La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique on the Internet is one of its main priorities. The Company Ju & A Group SPRL, Distributeur Lindt en Belgiquedeploys major efforts to ensure the effectiveness of its security measures. La Société Ju & A Group SPRL, Distributeur Lindt en Belgique applies the provisions of Law n°78-17 of 6 January 1978 relating to information technology, files and freedoms. Information on the nature, scope and purpose of the collection and recording, by La Société Ju & A Group SPRL, Distributeur Lindt en Belgique , of personal data necessary for the performance of the purchase contract can be found in our Privacy Policy.

 11. Limitation of liability

The Company Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held liable in the event of non-performance or poor performance due to a case of force majeure as defined by the case law of the French courts.

Similarly, Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held liable in the event of damage resulting from the Customer’s use of the Internet.

12. Exclusion of liability for third party hyperlinks

Similarly, Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held liable in the event of damage resulting from the Customer’s use of the Internet.

 13. Image rights and copyright

Société Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held liable in the event of non-performance or poor performance due to a case of force majeure as defined by the case law of the Belgian courts.

Similarly, Société Ju & A Group SPRL, La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt en Belgique may not be held liable for any damage resulting from the Customer’s use of the Internet network.

 14. Applicable law

The applicable law is Belgian law.  Disputes relating to or arising from the offers of La Société Ju & A Group SPRL, La Société Ju & A Group SPRL, Distributeur Lindt in Belgium or from sales contracts concluded with the latter must be submitted to the competent courts and tribunals of the jurisdiction of Brussels.

The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
